Zubik v. Burwell

If you are being watched, leave now!

At question was whether religious non-profits with an objection to providing contraception to women should have to actively opt out of doing so.

Full Case Title:

David A. Zubik et al. v. Sylvia Burwell, Secretary of Health and Human Services, et al.
  • Workplace Equality and Economic Empowerment

Year:

  • Reproductive Rights
  • Joined Amicus Brief

Brief:

The ACA mandated that all new insurance plans cover "contraceptive methods, sterilization procedures, and patient education and counselling for all women with reproductive capacity." A religious exemption exists for non-profit organizations with a religious objection to providing contraception. In order to opt out, the organization must notify the government and explain the objection. The petitioners, representing such religious non-profits, argue that this requirement is an infringement of the Religious Freedom Restoration Act, which bars the government from "substantially burdening" a person's "exercise of religion."
