Legal Momentum joined Amici Curiae in support of the District Court's holding that Defendant’s policy preventing a transgender student from using the bathroom based on gender identity violates both the Equal Protection Clause and Title IX since Title IX and the Equal Protection Clause prohibit sex discrimination against transgender individuals based on nonconformity to gender stereotypes.  In addition, protecting transgender students is a requirement under Title IX’s broad mandate of eradicating discrimination based on gender in education.
