Legal Momentum has joined former federal judge and Harvard Law Professor Nancy Gertner in a comment objecting to the proposed new discovery rules in federal civil cases.

“Discovery” occurs after a case is filed, and before the case goes to trial. It is the procedure by which a party can obtain information relevant to the case from an opposing party, such as by depositions, interrogatories, and requests for documents.  The comment by Legal Momentum and Professor Gertner opposes the proposed discovery changes because they would make it much more difficult for plaintiffs with bona fide discrimination claims to obtain the information they need to prove their claims.
