Prohibitions against Pregnancy Discrimination

It is an unlawful employment practice to discriminate based on sex.Sex discrimination includes discrimination based on pregnancy, childbirth, and related conditions.[1]

Pregnancy Accommodation

Kentucky does not provide additional protections to the federal law.

Pregnancy-related Disability Accommodation

Kentucky does not specifically accommodate pregnancy or its attendant medical conditions as a disability.

Breastfeeding Rights

A mother may breast-feed her baby or express breast milk in any location, public or private, where the mother is otherwise authorized to be. Breast-feeding a child or expressing breast milk shall not be considered an act of public indecency nor may a municipality enact an ordinance that prohibits breast-feeding or expressing breast milk or consider it indecent exposure.[2] It is unclear whether this authorization extends to a woman’s place of employment.

Family and Childcare Leave Laws

State Employers – Sick Leave

An employee may take sick leave to care for or transport a member of his immediate family in need of medical attention for a reasonable period of time that does not exceed one year, if the employee has used or been paid for all accumulated annual, sick, and compensatory leave.[3]

All Employers – Adoption Leave

Upon receiving written request by an employee, every employer shall grant reasonable personal leave not to exceed six weeks for the reception of an adoptive child under the age of seven.[4]
