Missouri--Laws Relating to Pregnancy

Prohibitions against Pregnancy Discrimination

It is an unlawful employment practice to discriminate based on pregnancy. Where the termination of a temporarily disabled employee is caused by a policy with insufficient or no leave is available, this termination is discriminatory if it has a disparate impact on one sex.[1]

Pregnancy Accommodation

Missouri does not provide additional protections to the federal law.

Pregnancy-related Disability Accommodation

Missouri does not specifically accommodate pregnancy or its attendant medical conditions as a disability.

Breastfeeding Rights

A mother may, with as much discretion as possible, breast-feed her child in any public or private location where the mother is otherwise authorized to be. [2] It is unclear whether this authorization extends to a woman’s place of employment.

Family and Childcare Leave Laws

State Employers - Sick Leave

A state employee who is an adoptive parent may use his or her accrued sick leave, annual leave, or the same leave without pay granted to biological parents to take time off to arrange for the adopted child's placement or caring for the child after placement.[1]

Private Employers with 6 or more Employees, State Employers – Disability Insurance and Leave

Disabilities caused or contributed to by pregnancy, miscarriage, legal abortion, childbirth and recovery are temporary disabilities and should be treated as such under a health or temporary disability insurance or sick leave plan available. Written or unwritten employment policies and practices involving any health or temporary disability insurance or sick leave, plan, formal or informal, shall be applied to disability due to pregnancy or childbirth on the same terms and conditions.[3]

Unemployment Compensation

Employees forced to leave their work because of pregnancy be eligible for unemployment benefits, if they returned to that employer as soon as they were physically able to return, but in no later than ninety days after the pregnancy.[4]
