Determined whether an employer violates federal anti-discrimination law (Title VII) by excluding contraceptives from a prescription drug plan that covers other prescriptions.
This case challenged a corporate policy that excluded coverage of prescription contraceptives from employee health plans that cover other prescription drugs and devices. It contended that excluding prescription contraceptives disproportionately harms women, and is therefore sex discrimination barred by Title VII. Legal Momentum supported plaintiffs as an amicus curiae, bringing the courts' attention to the serious health consequences of pregnancy for women. In July 2005, the Union Pacific case was decided with a strong ruling in favor of requiring coverage of contraceptives in the prescription drug plan.
