Legal Momentum submits these comments to express overall support for Enhancing Coverage of Preventive Services Under the Affordable Care Act Proposed Rule. This rule would expand access to coverage of recommended preventive services without cost sharing in the commercial market, with a particular focus on reducing barriers to coverage of contraceptive services, including over the counter (OTC) contraceptives.

The Pregnant Workers Fairness Act (PWFA) when into effect on June 27, 2023 and is vital to safeguarding the rights, health, and safety of pregnant workers. It requires that covered employers provide reasonable accommodations to workers related to pregnancy, childbirth, or related medical conditions. Legal Momentum just submitted a comment on proposed EEOC regulations implementing the Act to ensure that the PWFA is as strong as it can be.

On September 27, 2023 Legal Momentum's Staff Attorney, Kyra Batté, testified in NYC Council's hearing on "The Child Welfare System and the Mandatory Report of Child Abuse or Maltreatment in New York State" that covered biases within the system and future reform. Kyra argued that non-consensual drug testing has no place in the maternal care of pregnant persons as it violates their rights and has long-lasting consequences if child protective services become involved.

On June 26th, 2023, Kyra Batté, Staff Attorney, provided written and oral testimony before the New York City Council in support of Int 0811-2022, which would eliminate a longstanding retaliatory practice in settlement agreements used by employers that effectively penalize employees who challenge workplace discrimination. Today marks one year since the U.S. Supreme Court overruled Roe v. Wade and eliminated the federal right to abortion. The decision threatened the reproductive rights and autonomy of all birthing people, but as we know, it has affected some groups far greater than others. Low-income women, women of color, and the LGBTQ+ community continue to be disproportionately affected and harmed by the rollback of reproductive protections in the post-Roe era.

On May 15th, 2023, Legal Momentum submitted a public comment to the U.S. Department of Education's Office for Civil Rights supporting unequivocally, and without restriction, the right of transgender, nonbinary and intersex students to participate in school sports consistent with their gender identity.
