Public Comment on Rescinding Regulations Related to Nondiscrimination on the Basis of Sex in Education Programs

On May 16, 2025, the administration released five Direct Final Rules (DFR) that are attempting to remove critical civil rights protections from the Department of Energy's (DOE) regulations, including:

  • Two that would change DOE's Title IX regulations,
  • One that would DOE's Section 504 regulations,
  • One that would change DOE's regulations implementing Title VI and anti-sex discrimination laws to remove protections against discrimination based on disparate impact, and
  • One that would change DOE's Age Discrimination Act regulations.

 

These DFRs remove opportunities for girls and women to play sports and to participate in programs that seek to increase their participation in fields where they are underrepresented; remove regulations that address accessible buildings and education; and remove regulations that address the discriminatory impacts of policies and practices that harm underserved communities, particularly communities of color. 

 

In response to this, Legal Momentum issued a public comment strongly opposing the direct final rule (DFR), “Rescinding Regulations Related to Nondiscrimination on the Basis of Sex in Education Programs."
