Prohibitions against Pregnancy Discrimination
It is an unlawful employment practice to discriminate based on sex. Sex discrimination includes discrimination based on pregnancy, childbirth, and related conditions.
*Applies to employers with fifteen or more employees.
Nevada does not provide additional protections to the federal law.
Pregnancy-related Disability Accommodation
Nevada does not specifically accommodate pregnancy or its attendant medical conditions as a disability.
A mother may breast feed her child in any public or private location where the mother is otherwise authorized to be. It is unclear whether this authorization extends to a woman’s place of employment.
Family and Childcare Leave Laws
If an employer grants leave with pay, leave without pay, or leave without loss of seniority to his or her employees for sickness or disability because of a medical condition, it is an unlawful employment practice to fail or refuse to extend the same benefits to any female employee who is pregnant. The female employee who is pregnant must be allowed to use the leave before and after childbirth, miscarriage or other natural resolution of her pregnancy, if the leave is granted, accrued or allowed to accumulate as a part of her employment benefits.
*Applies to employers with fifteen or more employees
Employers must grant employees up to four hours of unpaid leave per school year for each child enrolled in school, to attend school-related activities.
*Applies to employers with fifty or more employees.
Employers may not discriminate against parents who attend school conferences at the request of a school administrator or for leaving work because of a child’s emergency. For the text of the statute, click here.
