Legal Momentum served as plaintiff co-counsel along with the firm Kaye Scholer LLC acting pro bono, the Workers' Rights Law Center of New York, and the North Carolina Justice Center.

 

Summary of the Case

This class action suit was filed against organizations that recruit and supply non-immigrant guest workers to U.S. farms. We alleged that the defendants discriminate on the basis of sex by directing female workers whom they recruit into jobs that carry an "H-2B" visa classification, which provide inferior pay and benefits compared to jobs with "H-2A" classifications. Outcome of the Case

After the defendants' motions to dismiss and/or for summary judgment were denied in part, and the case was certified as a class action, a settlement agreement was reached which is pending for the court's approval. The agreement provides injunctive relief to prevent future discrimination and a significant monetary settlement for our client.
